In Georgia, the statute of limitations for personal injury lawsuits is two years, while property damage lawsuits have a four-year limit. Damages recoverable from an at-fault driver include property damage, medical bills, pain and suffering, rental vehicle costs, lost wages, loss of consortium, and wrongful death.

  • Statute of Limitations:
    • Two years for personal injury lawsuits (O.C.G.A. 9-3-33)
    • Four years for property damage lawsuits (O.C.G.A. 9-3-32)
  • Damages:
    • In Georgia, you are entitled to recover from the at-fault driver the following damages:
      • Property Damage to your car and belongings in the vehicle;
      • Medical bills incurred for injuries sustained in the wreck;
      • Pain and suffering;
      • The reasonable cost of a rental vehicle while your vehicle is being repaired;
      • Lost wages due to the wreck (it is important to have medical documentation of your injuries that prevent your ability to perform your normal duties);
      • Loss of consortium (this includes a variety of elements, such as loss of affection or companionship from your spouse)
      • Wrongful death
    • You may also be entitled to what are referred to as, “punitive damages,” but those are currently capped at $250,000 (OCGA 51-12-5.1)
      • Punitive damages apply in cases of particularly reprehensible conduct, such as accidents caused by drunk driving.
  • Georgia has what is called a “modified comparative fault system,” which means injured parties must prove the other party's fault and recovery is possible if the injured party is less at fault.
    • Apportionment - Damages are reduced based on the percentage of fault, with 50% or more fault barring recovery.
  • Auto Insurance Requirements:
    • Georgia law requires every driver must have liability coverage, with minimum limits:
      • Bodily injury liability: $25,000 per person, $50,000 per incident
      • Property damage liability: $25,000 per incident
      • Uninsured motorist coverage isn't mandatory, but at Hummel Trial Law we highly recommend you carry uninsured or underinsured motorist coverage on your vehicle.
  • Statute of Limitations:
    • It is very important to know the deadlines for bringing a lawsuit against the at-fault driver:
      • Two years for personal injury claims,
      • Four years for property damage.
    • Timely consultation with an attorney is crucial to assess claim strength and meet filing deadlines.
      • Most uninsured motorist insurance policies require you to report the wreck within a month or so of the wreck.
